Business Kaki is a technology product developed, operated, and wholly owned by Simply Yours LLP, registered in Singapore. All data collection and processing described in this Privacy Policy is carried out by Simply Yours LLP on behalf of the Business Kaki platform.
1. Introduction
Welcome to Business Kaki ("we," "us," or "our"). We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains how Business Kaki, operated by Simply Yours LLP (UEN registered in Singapore), collects, uses, discloses, and safeguards information when you use our WhatsApp automation platform and related services (collectively, the "Service").
By accessing or using our Service, you agree to the collection and use of information in accordance with this policy. If you do not agree, please discontinue use of the Service immediately.
2. Information We Collect
2.1 Information You Provide Directly
- Business name, contact name, and email address (during onboarding)
- WhatsApp Business Account credentials and phone number(s)
- Payment and billing information (processed securely via our payment provider)
- Message templates and automation workflow configurations you create
- Support tickets and correspondence sent to admin@simplyyours.co
2.2 Information Collected Automatically
- IP addresses, browser type, and device information when you access our web dashboard
- Usage logs, feature interaction data, and session duration
- API call metadata (timestamps, endpoints invoked, response codes)
- Error logs and diagnostic data to maintain service reliability
2.3 Data from Meta / WhatsApp Cloud API
Business Kaki integrates with the Meta WhatsApp Cloud API. When you connect your WhatsApp Business Account, we receive and process:
- Inbound and outbound message content (text, media, interactive replies) to the extent necessary to operate your automation flows
- Sender phone numbers and WhatsApp profile display names of your end-customers
- Delivery and read-receipt status events
- Webhook payloads sent by Meta to our servers
We act as a data processor on behalf of your business for all WhatsApp message data. You, as the WhatsApp Business Account holder, remain the data controller for your customers' personal data. We strongly encourage you to maintain a Privacy Policy for your own customers in compliance with the Singapore Personal Data Protection Act (PDPA) and any other applicable laws.
Please also review Meta's WhatsApp Business Policy and Meta's Privacy Policy, as your use of our Service is also subject to those terms.
3. How We Use Your Information
We use collected information solely to:
- Provision, maintain, and improve the Business Kaki platform and its features
- Execute the automation workflows, chatbot responses, and scheduled messages you configure
- Authenticate and authorise your access to the dashboard and API
- Process billing and manage your subscription
- Respond to support requests and resolve technical issues
- Send transactional communications (e.g., service announcements, critical security alerts)
- Comply with applicable legal obligations
- Detect, investigate, and prevent fraudulent or abusive use of the Service
We do not sell, rent, or trade your personal data or your customers' personal data to third parties for marketing purposes.
4. Data Sharing and Disclosure
We may share information with:
- Meta Platforms, Inc. — as required to operate the WhatsApp Cloud API integration
- Cloud infrastructure providers — our servers are hosted on reputable cloud platforms (e.g., Supabase, Cloudflare) that process data on our behalf under data processing agreements
- Payment processors — to complete billing transactions (they receive only the data necessary to process payment)
- Legal authorities — where we are required to do so by applicable law, court order, or governmental regulation
- Business successors — in the event of a merger, acquisition, or asset sale, subject to standard confidentiality obligations
5. Data Retention
We retain your account data for as long as your subscription is active plus a period of 90 days after termination, to allow for dispute resolution and account recovery. WhatsApp message logs are retained for a rolling period of 30 days by default to support troubleshooting, after which they are automatically purged. You may request earlier deletion at any time (see Section 7).
6. Data Security
We implement industry-standard technical and organisational measures to protect your data, including TLS encryption in transit, encrypted storage at rest, access controls, and regular security reviews. However, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security and encourage you to use strong credentials and report any suspected security incidents to us immediately.
7. Your Rights and Data Deletion
Depending on applicable law (including the Singapore PDPA and GDPR where relevant), you may have the right to:
- Access the personal data we hold about you
- Correct inaccurate or incomplete data
- Request deletion of your personal data
- Object to or restrict certain processing activities
- Data portability — receive your data in a structured, machine-readable format
To exercise any of these rights, including submitting a data deletion request, please send an email to admin@simplyyours.co with the subject line "Data Request – [Your Business Name]". We will respond within 30 days. We may request proof of identity before processing your request.
8. Cookies and Tracking
Our web dashboard uses essential cookies for authentication and session management. We may use analytics cookies (e.g., from privacy-respecting analytics tools) to understand how the dashboard is used and to improve the product. You may disable non-essential cookies in your browser settings; however, this may affect certain dashboard features.
9. Children's Privacy
The Service is intended for business use only and is not directed at individuals under the age of 18. We do not knowingly collect personal data from minors. If you believe we have inadvertently collected such data, please contact us immediately.
10. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify registered users of material changes via email or an in-dashboard notice at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised policy.

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (or the business entity you represent, "Client") and Simply Yours LLP, the operator of Business Kaki ("we," "us," "Company"), governing your access to and use of the Business Kaki WhatsApp automation platform, APIs, dashboards, and related services (collectively, the "Service").
By registering for an account, clicking "I Agree," or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are acting on behalf of a company, you represent that you have authority to bind that company to these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Eligibility
To use the Service you must:
- Be at least 18 years of age and legally capable of entering into binding contracts
- Hold a valid WhatsApp Business Account approved by Meta Platforms, Inc.
- Operate a legitimate business with a registered business entity (where required by law)
- Not be located in a country subject to a Singapore or UN trade embargo, or on any government prohibited-party list
3. Account Registration and Security
You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at admin@simplyyours.co if you suspect any unauthorised access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
4. Permitted Use and Acceptable Use Policy
4.1 Permitted Use
You may use the Service solely for your internal business purposes to automate and manage WhatsApp communications with your customers, subject to these Terms.
4.2 Prohibited Conduct
You must not use the Service to:
- Send unsolicited bulk messages, spam, or any communication that violates WhatsApp's Business Policy or Meta's Platform Terms
- Transmit content that is illegal, defamatory, harassing, abusive, fraudulent, or infringes any third-party intellectual property rights
- Send communications to recipients who have not provided the required opt-in consent under applicable law
- Conduct phishing, impersonation, or deceptive marketing campaigns
- Promote or facilitate illegal activities, gambling, adult content (where prohibited), or sale of regulated goods without appropriate licences
- Attempt to reverse-engineer, decompile, disassemble, or derive source code from any part of the Service
- Probe, scan, or test the vulnerability of the Service or circumvent any security or authentication measures
- Use automated scripts, bots, or crawlers on our dashboard without prior written consent
- Resell or sublicence access to the Service to third parties without our written permission
- Take any action that imposes an unreasonable or disproportionate load on our infrastructure
We reserve the right to suspend or terminate your account immediately and without refund if we determine, in our sole discretion, that you have violated this Acceptable Use Policy.
5. Meta / WhatsApp API Compliance
Your use of Business Kaki for WhatsApp messaging is subject to the policies of Meta Platforms, Inc., including but not limited to the WhatsApp Business Policy, Meta Platform Terms, and Meta's messaging rate limits and template approval requirements.
- You are solely responsible for obtaining all necessary opt-in consents from your customers before sending them WhatsApp messages via the Service
- You must ensure all message templates you submit for Meta approval comply with Meta's template guidelines
- You acknowledge that Meta may impose messaging limits, quality ratings, or suspend your WhatsApp Business Account independently of any action by us
- We are not responsible for any suspension, limitation, or policy enforcement action taken directly by Meta against your WhatsApp Business Account
6. API Rate Limits and Fair Use
The Service is provided subject to usage limits as specified in your subscription plan. These limits include, but are not limited to, monthly message volumes, number of connected phone numbers, and API request rates. Exceeding your plan limits may result in:
- Automatic throttling or queuing of messages
- Suspension of API access until the next billing cycle
- An invitation to upgrade to a higher plan
We reserve the right to adjust rate limits at any time to protect platform stability, provided we give you at least 7 days' notice for changes that materially reduce your plan's limits.
7. Fees, Billing, and Payment
Subscription fees are billed in advance on a monthly or annual basis as selected during sign-up. All fees are quoted in Singapore Dollars (SGD) or as otherwise stated and are exclusive of applicable taxes (including GST) unless stated otherwise. Payment is due on the billing date. We use a third-party payment processor to handle transactions securely.
Failure to pay may result in suspension of your account after a grace period of 7 days. Accounts suspended for non-payment for more than 30 days may be terminated and data may be deleted. Fees paid are non-refundable except as expressly set out in our Refund Policy or as required by applicable law.
8. Intellectual Property
All intellectual property rights in and to the Service — including the software, design, branding, and documentation — are owned exclusively by Simply Yours LLP. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service during your subscription term solely for your internal business purposes.
You retain ownership of all content, data, and message templates you create through the Service ("Client Content"). You grant us a limited licence to store, process, and transmit Client Content solely to the extent necessary to operate the Service on your behalf.
9. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Service, and to use such information solely for the purpose of performing obligations under these Terms. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE OPERATION. We do not warrant that the Service will meet your specific requirements or that any defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMPLY YOURS LLP AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) SGD 500.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Indemnification
You agree to indemnify, defend, and hold harmless Simply Yours LLP and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including WhatsApp Business Policy; or (d) any claim by your customers arising from communications you sent via the Service.
13. Term and Termination
These Terms are effective from the date you first access the Service and remain in effect until your subscription is terminated. Either party may terminate the agreement by providing 30 days' written notice. We may terminate or suspend your access immediately without notice for: (a) material breach of these Terms; (b) violation of the Acceptable Use Policy; (c) non-payment; or (d) as required by law.
Upon termination, your right to access the Service ceases immediately. We will retain your data for 90 days post-termination before deletion, unless a shorter retention period is requested in writing. Sections 8, 10, 11, 12, 14, and 15 survive termination.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Singapore.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and any Order Form, constitute the entire agreement between you and Simply Yours LLP regarding the Service and supersede all prior agreements.
- Amendments: We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-dashboard notice. Continued use after the effective date constitutes acceptance.
- Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right under these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Force Majeure: Neither party is liable for delays or failures in performance caused by events beyond their reasonable control, including acts of God, governmental actions, or third-party service outages (including Meta platform outages).
